Does South Carolina Recognize Legal Separation?

Legal separation is not legally recognized in South Carolina. Instead, family courts will issue what is known as an Order of Separate Maintenance and Support. The court will issue this order to serve as a guideline for important issues such as child custody, visitation, and other matters that need to be addressed.

Spouses should understand that this type of legal action is only temporary until a final hearing or trial can occur. Individuals who wish to obtain a no-fault divorce are required to live separately for at least one year. What is a No-Fault Divorce?

South Carolina has what is known as no-fault divorce for individuals who have lived separately from their spouse for at least a year and do not wish to assign blame to the other party. Instead, irreconcilable differences are the only reasons that one spouse needs to be stated for a divorce to go forward.

Many individuals who wish to divorce choose the option of no-fault divorce because it typically does not stir up the level of contention as often seen in fault-based divorce.
